1. Introduction
This Acceptable Use Policy ("Policy") governs your use of applications developed by Open Works Digital Ltd, trading as Proof and available through the monday.com marketplace.
This Policy should be read alongside our Terms of Service and Privacy Policy.
2. Permitted Use
Our applications are intended for:
- Monitoring and analysing workspace activity within monday.com
- Generating reports and insights to improve team productivity
- Legitimate business purposes in compliance with applicable laws
- Use by authorised users within your organisation's monday.com workspace
You may also use our applications to:
- configure dashboards, widgets and views within the limits of your subscription tier
- share reports with people in your organisation who are entitled to see the underlying monday.com data
- evaluate the applications during any free trial offered through the monday.com marketplace
- use the outputs in your own internal processes, provided the data stays subject to your organisation's monday.com permissions
Any other use is permitted only if it is consistent with this Policy, our Terms of Service and monday.com's terms. If you are unsure, contact us before you proceed.
3. Prohibited Activities
You must not use our applications to:
- Violate any applicable laws, regulations, or third-party rights
- Access data or functionality beyond what is authorised for your account
- Attempt to reverse engineer, decompile, or extract source code from our applications
- Interfere with or disrupt the integrity or performance of our applications
- Use automated means to access our applications beyond normal usage patterns
- Collect or harvest data about other users without their consent
- Transmit malware, viruses, or other malicious code
- Impersonate another person or entity
- Use our applications for surveillance of employees without proper disclosure and consent
You must also not:
- process personal data through our applications without a lawful basis, or in any other way that breaches the UK GDPR, the Data Protection Act 2018 or, where it applies, the EU GDPR
- monitor workers in a way the Information Commissioner's Office's employment guidance would treat as excessive or undisclosed
- make decisions about an individual's employment, such as discipline, dismissal or pay, based solely on activity data from our applications without meaningful human review (UK GDPR, Article 22)
- gain or attempt unauthorised access to our systems, to monday.com accounts or to data, or test their security without our written permission (Computer Misuse Act 1990)
- copy, resell, sublicense or redistribute our applications or their outputs, or otherwise infringe our intellectual property (Copyright, Designs and Patents Act 1988)
- share access with anyone outside your organisation, or get around usage limits, subscription tiers or billing controls
- use our applications in connection with fraud or any other unlawful activity (Fraud Act 2006)
- use our applications to harass or discriminate against any person (Equality Act 2010)
References to legislation are to UK law as amended from time to time. They are examples, not a complete list.
4. Compliance with monday.com Terms
Your use of our applications must also comply with monday.com's terms of service, acceptable use policy, and any other applicable monday.com policies.
In the event of any conflict between this Policy and monday.com's terms, the more restrictive provision shall apply.
5. Enforcement
We reserve the right to investigate any suspected violations of this Policy. If we determine that a violation has occurred, we may take action including:
- Issuing a warning
- Temporarily suspending access to our applications
- Permanently terminating access to our applications
- Reporting the violation to relevant authorities
- Taking legal action to recover damages
How we investigate and act:
- When we become aware of a possible breach, we review the information available to us. We may ask you for more information, and you agree to cooperate with reasonable requests.
- Where a breach is not serious and can be put right, we will normally email your account administrator, explain the problem and give you 14 days to fix it.
- We may suspend access immediately, without notice, if we reasonably believe the use puts security, other users or monday.com at risk, or breaks the law. We will tell you as soon as reasonably practicable after we do.
- If a breach is not put right, is repeated or is serious, we may end your access permanently under our Terms of Service.
- You can ask us to review a decision by emailing us within 14 days. We will respond within 14 days of receiving your request.
- We may tell monday.com about a breach that affects its platform, and the relevant authorities where the law requires it.
- Billing, refunds and cancellation are governed by our Terms of Service and the monday.com marketplace terms.
- If we do not act on a breach straight away, we can still act on it later.
